Planning and permits
Zoning plan
The municipality's binding plan for what may be built and used on a site.
The zoning plan sets the type and extent of use, such as zone category, site coverage, heights and building lines. It decides whether logistics or production is permitted and how large a building may be.
Content and effect
The development plan (Bebauungsplan) is a municipal by-law. It sets the type and intensity of use, building style, buildable areas and transport and green spaces. Projects within its scope are permissible under Section 30 of the German Building Code if they comply with its provisions and access is secured. Textual provisions often contain decisive restrictions, for example on logistics, retail or emission quotas.
Preparation and amendment
New plans or amendments go through a procedure with public and authority participation, environmental assessment and a balancing decision by the council. This usually takes one to several years. With a project-related development plan under Section 12 of the Building Code, an investor plans a specific project together with the municipality and undertakes to implement it in an implementation agreement.
