Planning and permits

Emission control permit (BImSchG)

A permit under the Federal Immission Control Act for facilities with significant environmental impact.

Warehouses holding large quantities of certain hazardous substances, some production and larger refrigeration plants need an emission control permit instead of or in addition to a building permit. The procedure is more extensive and takes longer.

When it is required

Annex 1 of the 4th Federal Immission Control Ordinance lists the installations that require a permit. For logistics, the most relevant are stores of certain hazardous substances above quantity thresholds, refrigeration plants with larger ammonia charges and production plants in sectors such as metals, chemicals or food. The immission control permit includes the building permit.

Procedure

A distinction is made between the simplified procedure without and the formal procedure with public participation. Reports on noise, air, major accident prevention and possibly an environmental impact assessment extend the duration. For buyers and tenants, it matters whether an existing permit can be transferred and what conditions apply.
